Are you serious? Which 2? I see one &quot;Chen&quot; among the five accused. Are you suggesting that it's a sanctioned practice of the business to beat up employees when they are out of line? And are you also suggesting that they were acting on Wayne Chen's behalf? That's not only a leap of judgment, it's irresponsible.

If what the brothers and managers of that branch did, was done in the good old USA, the whole corporation and it's CEO would be held responsible.


If the managers who happen to be brothers of teh CEO assaulted a worker for mishandling of company property, it is obvious that they are acting according to company policy.

So let me understand your argument (if it can be called such):

Managers beat employees.
Therefore, it is the policy of the company to beat employees.

Should I even waste my time to point out the obvious logical fallacy here. You know, for you who never miss an opportunity to brag about how smart you are, this line of reasoning can only proceed from a dunce head. Sorry! I don't care what degrees you claim to have.

I strongly recommend you take a crash course in Logic 101.

Not wanting to stray from the topic, but there is no logical fallacy here.

Fact is IF A MANAGER BEATS/ATTACKS A MEMBER OF STAFF - THE COMPANY WILL BE HELD IS RESPONSIBLE. Legal repercussions will be targeted at the company (this is UK - thus most probably also Ja - I suspect this is the case in US, as well as and many other developed countries).
If such occurances are likely, yet a company does not have sufficient policies in place to safeguard the employee, or offer remedy (e.g. disciplinary action, etc.) then it can be construed that the company are supportive of such actions.

Though it will not stop the employee from also seeking other legal remedy - in this case there is also likely to be criminal offences.

Just to try to put this in context - think of a situation if a manager was to sexually harass an employee - who is deemed responsible?

There's a difference between who's responsible (in this case, the one manager, and the other four supervisors), and having a policy in place, ie, one that calls for the beating of employees, which is what you and the doc are asking us to believe is the case here. So this alleged crime, most deplorable if it is true, is deemed the policy of the company? Good luck in court with that. You should note that line is not being pursued by the prosecutors in Mandeville. The five are being charged, one with assault, and the other four with assault and battery. Something is clouding your judgement; I'm not sure what it is.

The Jamaica Labour Party (JLP) is seeking to refute reports that members of and close affiliates of the party have had their United States (US) visas revoked.

&quot;We know nothing of that ... we've heard like everyone else, rumors circulating but we know nothing that would in any way cause us to be concerned. We know of no reasons why the action was taken and until more details are provided, if indeed they are provided, we have no intention of giving any credence to the wild speculation that we have been hearing,&quot; said Karl Samuda, JLP General Secretary.

News broke on Thursday that Wayne Chen, Chairman of the state-run Urban Development Corporation, had his US visa cancelled.

On Saturday, David Rowe, immigration attorney and Professor of law at the University of Miami, attributed the cancellation of Mr. Chen's US visa as a major signal being sent to the Jamaican government by the US authorities.

According to Professor Rowe, the US government is not very happy with the Bruce Golding led administration over its refusal to extradite West Kingston strongman Christopher &quot;Dudus&quot; Coke.

He added that persons in Jamaica who have been influencing the government not to honour the extradition treaty will be investigated by the US government. 

However, Mr. Samuda has dismissed those claims.

&quot;Mr. Rowe appears to have a wild imagination that from time to time reveals itself in all sorts of outrageous utterances. We know of no such intention on the part of the United States and until greater details are provided, we're not prepared to give it any credence,&quot; he said.

The JLP General Secretary added that the government is still investigating the revocation of Mr. Chen's US visa.

This as the row between the US government and Jamaica over cooperation on the extradition treaty heats up.

David Rowe, Professor of Law at the University of Miami and constitutional rights lawyer, is predicting that more Jamaicans seeking US visas will be denied entry.

In an interview with RJR News, Professor Rowe said the cancellation of Mr. Chen's US visa is a sign that the American authorities intend to toughen their stance against the government, which it deems to be in violation of the extradition treaty.

&quot;I predicted that there would be a reduction of visas, there would be a visa reaction. <span style="font-size: 17pt">I also predicted that there would be an obstruction of justice investigation and I predicted that people, who are involved in making the political decisions at the highest level in Jamaica, will bear the brunt of the American response.</span>

I think it's irresponsible for the adjunct law professor to be speculating as to the reason for Mr Chen's visa being canceled. He has stopped just short of saying that the cancellation is linked to the denial of the extradition request from US authorities regarding Dudus.

It should be known by anyone by now that if the US is upset over the government's handing of the Dudus affair, they wouldn't be so subtle about it; it would have been made known to the government in no uncertain terms. The US wouldn't have to be acting 'sneaky' with moves like cancelling a visa for someone like Chen, in order to make a point. There would be higher targets, bigger fishes, to get, more powerful and richer than Chen, believe it or not.

There's also another assumption being made here: that an extradition request must be acquiesced to at all times.

Wayne Chen.Wayne Chen, Chairman of the Urban Development Corporation, is awaiting word on whether he will be issued a new United States visa.

Mr. Chen, who has been in the spotlight since discovering a week ago that his visa had been revoked, applied for a new one on Monday.

His application followed another round of diplomatic talks involving Deputy Prime Minister Dr. Ken Baugh and officials of the US Embassy in Kingston.

Mr. Chen says he expects the processing of his visa application to be hassle-free.

&quot;I met with a senior official at the US Embassy and he suggested that I reapply and they would make a strong recommendation for a new visa. He said this should happen in due course as (the revocation) was really out of their hands and they have no further information about this.

&quot;He said this should not affect my reapplication for a new visa,&quot; Mr. Chen said.
